Stylus Engravers Terms and Conditions

Definitions

  • 'Customer' any person who wishes to purchase goods and/or services from Stylus Engravers Ltd.
  • 'Goods' products and/or services as listed on the website or offered by Stylus Engravers Ltd.
  • 'Order' any order made by a Customer for the purchase of Goods and /or services
  • 'Seller' Stylus Engravers Ltd., www.stylusengravers.co.uk and www.celebrationbottles.co.uk

1. Conditions

These Terms and Conditions do not affect your statutory rights as a consumer. These Terms and Conditions explain your rights and obligations. Please read them carefully. All Orders shall be subject to acceptance of these Terms and Conditions which shall prevail over any other document or communication from the Customer. The Seller reserves the right to change these terms and conditions at any time.

2. Order

The Seller reserves the right to reject any Order for any reason.
The Customer is responsible for ensuring that all details and instructions are accurate and complete on the Order. All Orders are subject to stock availability. The 'Seller' reserves the right to make any minor change to Goods without notice. In the event that the Goods ordered are unavailable, the Seller shall notify the Customer to advise of due delivery date or to offer alternative Goods. If we are unable to supply, and you have already paid, you will receive a full refund. Please notify us immediately if anything in the Order is incorrect. Once your Order is confirmed this is when the contract is made.

3. Prices

The prices for the Goods shall be the prices displayed on the website on the date of Order with the following exception: Should a product's price change between receipt of order and dispatch the Customer shall be notified and given the opportunity to cancel the Order and receive a full refund. All prices are shown in £ s sterling and include VAT (where applicable) at the current rate but excludes delivery charges. The total purchase price will be displayed in the Customers shopping cart prior to confirming the Order

4. Payment

Payment must be made via the website by the Customer at the time of the Order, or via telephone. We accept all major debit and credit cards. However, we do not accept American Express. Account Customers strictly net 30 days from date of invoice, if you fail to pay us on the due date we may: suspend or cancel any future Orders, charge you interest at 4% above Bankof England base rate calculated (on a daily basis) from the date of our invoice until payment, compounded on the first day of each month: and, before and after any judgement (unless a court orders otherwise). If any act or proceedings shall be commenced in which the Customer's solvency is concerned, all monies under any transaction covered by these Conditions shall become immediately due and payable.

5. Delivery

The Goods will be dispatched by courier or Royal Mail. Whilst every effort shall be made to keep any delivery date, time of delivery shall not be of the essence and the Seller shall not be liable for any losses, costs, damages, of expenses incurred by the Customer or any other person or Company arising directly or indirectly out of any failure to meet an estimated delivery date. Delivery of the Goods shall be made to the Customer's address. The Customer, or authorised person, must sign for each delivery of the Goods. Delivery may be delayed if no-one is available to sign.

6. Ownership and Risk

The Goods are at your risk from the time of delivery. Delivery takes place either: at our premises( if you are collecting them or arranging carriage) or at your Order delivery address specified by you (if we are arranging carriage) or upon the Goods being appropriated to the Customer but kept at the Seller's premises at the Customer's request. The Customer shall inspect the Goods immediately upon receipt and shall notify if any Goods are damaged or not delivered, in writing, within 7 days of delivery or expected delivery time. If the Customer fails to do this he is deemed to have accepted the Goods. Property in the Goods will not pass to the Customer until the Seller receives in cash or cleared funds payment in full of the Goods and all other Goods agreed to be sold by the Seller to the Customer for which payment is then due. Until then the Customer shall keep the Goods stored, protected and insured. Any Goods in respect of which any claim of defect or damage is made shall be preserved by the Customer intact together with the original packaging at the Customer's risk and either: retained by the Customer for a reasonable period to enable the Seller or it's agent to inspect or collect the Goods at the Seller's option returned by the Customer to the Seller who will refund the cost of postage and packing to the Customer if the Goods are in fact defective.

7. Cancellation and Returns

In accordance with the Consumer Protection (Distance Selling) Regulations 2000, subject to conditions, the Customer has the right to cancel any Order for any reason and get a full refund at any time before he receives the Goods, or up to 7 working days after he receives the Goods. To cancel the Order the Customer must put it in writing, within that time to the address in the contact us page. The right to cancellation is not available to Goods already personalised. Cancelled Orders shall be returned in re-saleable condition, in original packaging and protected and insured during transit at your own cost. We recommend you use a “ signed for” service. The Seller reserves the right to make a handling and restocking charge of 25% on Goods which are returned if they where ordered in error or are no longer required . If the Goods are faulty or being returned under warranty then your postage charges will be refunded. Please allow 7 days.

8. Warranty

We warrant that the Goods comply with the Sales of Goods Act 1994. If you believe we have supplied Goods that are defective in materials or workmanship, you must: inform us in writing by letter/facsimile/email with full details within 3 days of receiving said Goods. You must allow us to investigate and if the Goods are found to be defective in material or workmanship (following our investigation), we will (at our option) repair the Goods, offer a replacement or refund the price. Whilst every effort is made to ensure that the Goods described on this web site are accurate, manufacturers may alter specifications. Inevitably there will be a delay before the product descriptions are updated reflecting these changes. It is highly recommended that an evaluation of the chosen Good(s) is carried out to ensure it meets with your requirements prior to purchase.

9. Liability

The Seller will not be liable for any other loss or damage (including indirect or consequential loss, financial loss, loss of profits or loss of use) arising from the contract or the supply of Goods or their use, even if we are negligent. Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under applicable law. The Seller will use reasonable endeavours to verify the accuracy of any information on the website but makes no representation or warranty of any kind express or implied statutory or otherwise regarding the contents or availability of the website or that it will be timely or error-free, that defects will be corrected, or that the website or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the website. The Seller will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website and the Seller accepts no liability of any kind for any loss or damage from action taken or taken in reliance on material or information contained on the site.

10. Data Protection

The Customer agrees to the processing of their personal data in order to process each Order and provide information about the Goods. The Seller shall comply with all relevant legislation including the Data protection Act 1998. We do not sell or pass your details on to anyone else in any circumstances. Should you want your details removed from our system then please write to the address in the contact us page.

11. Miscellaneous

Images supplied on the websites may not be displayed as actual size. All sizes, weights and measurements are approximate and are included for guidance only. Product photography, showing personalisation, does not imply that the Seller was originally commissioned or that the Seller endorses any company in the product photography. Any contracts shall in all respects be construed and operate as an English contract and in conformity with English law.

12. Force Majeure

In the event that the Seller is prevented from carrying out its obligations under a contract for sale as a result of any cause beyond it's control such as but not limited to Acts of God, War, Strikes, Lock-outs, Flood and Failure of third parties to deliver goods, the Seller shall be relieved of it's obligations and liabilities under such contract for sale for as long as such fulfilment is prevented.

13. Sale of alcohol
